Employment discrimination ! I have been fired!
I can only ask my friends in this group about this horrific event happening to
me.
I am a professional manager at a local company and was fired yesterday from my
position one week prior to my surgery for being unable to complete the tasks of
my job.
I have been on the job for 7 years and got in a little snub with my supervisor
about my “tone” to co-workers when using my email but otherwise have had no
issues in 7 years.
I had a review last July which said I was “excellent” in 90% of the categories
and was an extreme asset to the company. Now I am unable to complete my job,
after applying and being approved for my 3rd FMLA absence in 2 years do to my MO
problems.
I was told to get my coat and my handbag and go immediately to the boardroom
next to the president’s office and was told I was being terminated from my
current position. They said they would “honor” my leave that was approved,
however, I was strongly advised to seek other employment during my medical
leave. Then after my leave was over it was up to me to post for other positions
in the company, however, after reviewing my file I would “likely not get hired”
as well as the fact that my salary was double any of the current jobs available.
I am fired, but not fired, I can only believe with a clean history that it is
directly related to my FMLA leave. What are my rights?? Oh god, I am a single
mom with a mortgage, a car, no child support and looking for a job in a
recession?! What should I do about my surgery in a week? I am afraid with my
lack of sleep and extreme depression I will have trouble with my surgery?
Please my friends.. give me some words of advise..

What I would tell you to do is go through with your surgery — especially
since the company is honoring your leave that means they also must pay for
medical costs incurred under insurance while on leave. So definitely have
surgery. Then smile prettily, say goodbye and get yourself to a lawyer.
Don’t worry about going back to this company because in a year or so they
will realize that they were idiots. Until then take what you can — namely a
chance at health so these issues don’t arrive at other jobs — and go from
there. A company CAN NOT penalize you for taking advantage of FMLA so that
is grounds I would think to fight them. You need legal advice from someone
who deals with employment discimination — Walter could probably help you.
